Updates on the Andrew Lawsuit


  (22 August 2011, Hong Kong) – Reference is made to the voluntary announcement of Comba Telecom Systems Holdings Limited (Hong Kong stock code: 2342) and certain members of the Group (“the Company”) dated 17 June 2011 (the “Announcement”) in relation to the litigation against the Company by Andrew LLC (“Andrew”) with respect to an alleged patent infringement by the Company. Unless otherwise stated, capitalised terms used herein shall bear the same meanings as defined in the Announcement.

As disclosed in the Announcement, the patent covering Andrew’s RET Antenna was declared void by the Beijing Intermediate People’s Court in late 2010. Andrew appealed the decision to the Beijing High People’s Court. On 16 August 2011, the Beijing High People’s Court issued an order confirming the decision of the Beijing Intermediate People’s Court. With the court decision, the Company has therefore applied to the Patent Reexamination Office of the State Intellectual Property Office to confirm that the patent asserted by Andrew in China shall be revoked. The final order from the Beijing High People’s Court supports the Company’s position in the application.

In relation to the litigation in Brazil, the Company is pleased to announce that the Brazilian courts have refused Andrew’s requests for an order that would limit or otherwise interrupt the Company’s sales of relevant antenna products. The Company is considering the possibility of filing counterclaims in Brazil against Andrew.

The Company will make further announcement(s) as and when appropriate pursuant to the requirements of the Listing Rules Governing the Listing of Securities on The Stock Exchange of Hong Kong Limited.
